7 :
COMPOSITION OF TALUKA ADMINISTRATION |
Article
7.1 : There
shall be Taluka Panchayat in every Taluka composed of all the elected Gram
Pratinidhis in the taluka. Article
7.2 : Taluka
Panchayat will meet every month. But Taluka Panchayat
can be convened at any time with the notice of one day on telephone
by the 20% gram pratinidhis. Article
7.3 : Every
year after the elections of Gram Pratinidhis, each Gram pratinidhi of
Taluka will suggest one name by secret ballot for the post of (i) Taluka
president (ii) Taluka Pratinidhi
by writing in a special suggestion ballot paper for each particular
post. Nobody can write his own name. Article
7.4 : Every
gram pratinidhi will be entitled to give number of votes equivalent to the
population
he represents devided by one thousand. Fractions will be ignored. Article
7.5 : Where
population of a village is less than one thousand, such gram pratinidhi
can assign his voting right to any other gram pratinidhi in such a way
that eligible gram pratinidhi will represent population of two villages
(one of his own and another smaller village of which gram pratinidhi has
assigned the voting power to him). Illustration
: village A has population 7600. So gram pratinidhi of village A
will be entitled to give seven votes.
Village B has population of 900. The gram pratinidhi of village B
may assign his voting rights to gram pratinidhi of village A. Then total
votes to be given by gram pratinidhi of village A will be 7600 + 900
devided by 1000 = 8 votes (fractions to be ignored.) to each of the 3
posts. Article
7.6 : The
person getting highest vote in the suggestion ballot for a particular post
shall be requested to hold that post and if he agrees, his name will be
announced for the approval of the Taluka Panchayat and any objections is
to be presented by any person it will be invited. If no bonafide
objections are obtained, that person will be declared as elected for that
particular post. Article
7.7 : Any
person getting the highest vote for any particular post is not willing to
accept that post but he is willing to accept another post, both the
persons getting the highest votes for both the posts will be requested to
sit jointly with Taluka Nyay Punch Pramukh and resolve the problem of
distribution of posts among both the persons. Article
7.8 : Taluka
Panchayat pramukh or Taluka pratinidhi will hold the office during the
pleasure of the Taluka Panchayat but not more than one year and he will
leave the post forthwith on passing of call back resolution against him. Article
7.9 : Taluka
nyay punch pramukh will hold the office for three years unless call back
resolution has been passed by the Gram Nyay Punch of villages representing
80% population of Taluka. Article
7.10 : Call
back resolution against taluka Panchayat pramukh or taluka pratinidhi can
be passed by simple majority in Taluka Panchayat at any moment. Article
7.11 : No
person shall be eligible to be elected as taluka Panchayat pramukh or as
taluka pratinidhi or as taluka nyay punch pramukh unless (i) He/she is
citizen of India (ii) He/she has completed 21 years of age. (iii) He/she
is free from any addiction such as Smoking, Gutkha, Pan, Tobacco, Wine,
Gambling or any such bad habit. (iv) He/she declares the property of his
own and of his family members to the public. And there is no opposition
about the unlawful manner of acquiring the property. (v) He/she is not
convicted of any offence. (vi) He/she bears undisputable moral character.
(vii) He/she is graduate of any university. (Taluka Panchayat can relax
this requirement where there is no much education). (viii) He/she has read
atleast 5 books written by Mahatma Gandhi including Autobiography of
Mahatma Gandhi.
(ix) He/she has studied constitution of India.
Article
7.12 : Taluka
Panchayat will act as executive and implementing body of all the village
of Taluka and take suitable actions for the security freedom and the
development of the people of Taluka as per the provisions in the
constitution. Article
7.13 : Taluka
Panchayat may appoint unanimously various samitis for the purpose of
various functions and subjects related with the Village List and district
list wherever applicable. 40% members of such samitis will be women.
Member in the samitis may or may not be member of Taluka Panchayat. Article
7.14 : Any
samiti constituted by taluka Panchayat for any subject related to women
directly or indirectly shall have all women members. Subject to the
provision that all women members unanimously may co-opt one or two male
members if they desire. Article
7.15 : Taluka
Pratinidhi will represent the population of Taluka at every election for
any bigger organization out of the village such as District Panchayat,
Rajya Vidhan Sabha, Rajya Nyay Parishad, Lokshabha etc. as per the
provisions of this constitution.
TALUKA
JUDICIARY : Article
7.16 : There
shall be Taluka Nyay Samiti in every District. Article
7.17 : Number
of members of Taluka Nyay Samiti will be equivalent to population of the
Taluka divided by 25000 (fraction to be ignored) Article
7.18 : Members
of Taluka Nyay Samiti will be selected and elected as per the following
procedure : (a)
Entire Taluka will be divided into various constituencies for this
purpose equivalent to the number of members with more or less equal
population. (b)
Every Gram Nyay Punch Pramukh will have voting rights equivalent to
population which he represents divided by 1000. Each vote will be in a
special white ballot paper. (c)
Every Gram Nyay Punch Pramukh will suggest and write down one name
in one ballot paper which he considers best person as the member of Taluka
Nyay Samiti. He can write same name in all the ballot papers he is
entitled to cast. or different different names in each ballot paper in his
possession. (d)
Person getting the highest votes in this system will be requested
to accept the membership of Taluka Nyay Samiti. If he agrees and if he
fulfills the qualifications required for Taluka Nyay Punch Pramukh, his
name will be informed to all the voters i.e. All Gram Nyay Punch Pramukhs
to invite objections if any. If there is no any serious objection, he
becomes member of Taluka Nyay Samiti. (e)
If he does not agree, next person getting the second highest votes
will be requested to accept the membership of the Taluka Nyay Samiti and
procedure will be repeated. Article
7.19 : Members
of Taluka Nyay Samiti will select one person as the chairman of the Taluka
Nyay Samiti i.e. Taluka Nyay Punch pramukh as per the above method by
suggesting only one vote for each member. Article
7.20 : Chairman
of Taluka Nyay Samiti will hold the office for three years unless call
back resolution has been passed by the members of the Taluka Nyay Samiti
with 80% votes of the totally casted votes. Article
7.21 : Taluka
Nyay Samiti may appoint unanimously different samitis for the purpose of
various functions and subjects related with justice. Decision of such
samitis will be considered as the decision of Taluka Nyay Samiti. Article
7.22 : Taluka
Nyay Samiti will have powers and jurisdiction to decide the cases of
disputes and offences and appeals between the individuals, between
individual and village or Government authority,
between villages or any Government authority and punish the
culprits as per their discretion. Article
7.23 : Taluka
Nyay Samiti has the responsibility to see that administration of the
Taluka is
conducted as per the provisions of the constitution. Any person, can
complain to the Taluka Nyay Samiti if birth rights are violated or
Compulsory Commands are violated or Restrictions On Governments are not
complied with and any provision of constitution is violated. Taluka Nyay
Samiti will give the judgment at their discretion. |
