CHAPTER 8 : COMPOSITION OF DISTRICT ADMINISTRATION |

Article
8.1 : There
shall be Jilla Panchayat in every District composed of all the elected
Taluka pratinidhis in the District. Article
8.2 : Jilla
Panchayat will meet every month. But Jilla Panchayat can be convened at
any time with the notice of 3 days by telephonic notice by the 30%
Taluka pratinidhis. Article
8.3 : Jilla
Panchayat will elect Jilla Panchayat pramukh & Jilla Pratinidhi
unanimously from the members of the Jilla Panchayat. Article
8.4 : If
above system does not work successfully, all gram pratinidhis will elect
jilla pratinidhi by secret ballot by giving one vote for every 1000
population which the gram pratinidhi represents. (fractions to be
ignored) Article
8.5 : Every
gram pratinidhi will be entitled to give number of votes equivalent to
the population he
represents devided by one thousand. Fractions will be ignored. Article
8.6 : Where
population of a village is less than one thousand, such gram pratinidhi
can assign his voting right to any other gram pratinidhi in such a way
that eligible gram pratinidhi will represent population of two villages
(one of his own and another smaller village of which gram pratinidhi has
assigned the voting power to him). Illustration
: village
A has population 7600. So gram pratinidhi of village A will be entitled
to give seven votes. Village B has population of 900. The gram pratinidhi of
village B may assign his voting rights to gram pratinidhi of village A.
Then total votes to be given by gram pratinidhi of village A will be
7600 + 900 devided by 1000 = 8 votes (fractions to be ignored.) to each
of the 3 posts. Article
8.7 : Each
Gram Pratinidhi in the district will suggest at least one name by secret
ballot for the post of (i) Jilla President from the elected taluka
pratinidhis (ii) Jilla Pratinidhi from the elected taluka pratinidhis by
writing in a special suggestion ballot paper for each particular post. Article
8.8 : The
person getting highest vote in the suggestion ballot for a particular
post shall hold that post. Article
8.9 : Jilla
Panchayat pramukh or Jilla pratinidhi will hold the office during the
pleasure of the Jilla Panchayat and he will leave the post forthwith on
passing of call back resolution against him. Article
8.10 : Call
back resolution against Jilla Panchayat pramukh or Jilla pratinidhi can
be passed by simple majority in Jilla Panchayat at any moment. Article
8.11 : No
person shall be eligible to be elected as Jilla Panchayat pramukh or as
Jilla pratinidhi or as Jilla nyay samiti pramukh unless (i) He/she is
citizen of India (ii) He/she has completed 24 years of age. (iii) He/she
is free from any addiction such as Smoking, Gutkha, Pan, Tobacco, Wine,
Gambling or any such bad habit. (iv) He/she declares the property of his
own and of his family members to the public. And there is no opposition
about the unlawful manner of acquiring the property. (v) He/she is not
convicted of any offence. (vi) He/she bears undisputable moral
character. (vii) He/she is graduate of any university. (viii) He/she has
read atleast 5 books written by Mahatma Gandhi including Autobiography
of Mahatma Gandhi and Satyagrah in South Africa.
(ix) He/she has studied constitution of India.
Article
8.12 : Jilla
Panchayat may appoint unanimously various samitis for the purpose of
various functions and subjects related with the Village List, District
list and State List wherever applicable. 30% members of such samitis
will be women. Article
8.13 : Any
samiti constituted by Jilla Panchayat for any subject related to women
directly or indirectly shall have all women members subject to the
provision that all women members unanimously may co-opt one or two male
members if they desire. DISTRICT
JUDICIARY : Article
8.14 : There
shall be Jilla Nyay Samiti in every District. Article
8.15 : Number
of members of Jilla Nyay Samiti will be equivalent to population of the
district divided by 100000 (fraction to be ignored) Article
8.16 : Members
of Jilla Nyay Samiti will be selected and elected as per the following
procedure : (a) Entire District will be divided into various constituencies for this
purpose equivalent to the number of members with more or less equal
population. (b) Every Gram Nyay Punch Pramukh will have voting rights equivalent to
population which he represents divided by 1000. Each vote will be in a
special white ballot paper. (c) Every Gram Nyay Punch Pramukh will suggest and write down one
name in one ballot paper which he considers best person as the member of
Jilla Nyay Samiti. He can write same name in all the ballot papers he is
entitled to cast. or different different names in each ballot paper in
his possession. (d)
Person getting the highest votes in this system will be requested
to accept the membership of Jilla Nyay Samiti. If he agrees and if he
fulfills the qualifications required for Jilla Nyay Punch Pramukh, his
name will be informed to all the voters i.e. All Gram Nyay Punch
Pramukhs to invite objections if any. If there is no any serious
objection, he becomes member of Jilla Nyay Samiti. (e) If he does not agree, next person getting the second highest votes
will be requested to accept the membership of the Jilla Nyay Samiti and
procedure will be repeated. Article
8.17 : Members
of Jilla Nyay Samiti will select one person as the chairman of the Jilla
Nyay Samiti as per the above method by suggesting only one vote for each
member. Article
8.18 : Chairman
of Jilla Nyay Samiti will hold the office for three years unless call
back resolution has been passed by the members of the Jilla Nyay Samiti
with 80% votes of the totally casted votes. Article
8.19 : Jilla
Nyay Samiti may appoint unanimously different samitis for the purpose of
various functions and subjects related with justice. Decision of such
samitis will be considered as the decision of Jilla Nyay Samiti. Article
8.20 : Jilla
Nyay Samiti will have powers and jurisdiction to decide the cases of
disputes and offences and appeals between the individuals, between
individual and district or Government authority,
between talukas, between villages or any Government authority and
punish the culprits as per their discretion. Article
8.21 : Jilla
Nyay Samiti has the responsibility
to see that administration of the District
is conducted as per the provisions of the constitution. Any
person, can complain to the Jilla Nyay Samiti if birth rights are
violated or Compulsory Commands are violated or Restrictions On
Governments are not complied with and any provision of constitution is
violated. Jilla Nyay Samiti will give the judgement at their discretion. |
