CHAPTER 9 : COMPOSITION OF STATE ADMINISTRATION |
Article
9.1 : There
shall be Vidhan sabha in every state composed of all the elected Taluka
pratinidhis in the state. Article
9.2 : Vidhan
Sabha will meet every two months. But Vidhan Sabha can be convened at any
time with the notice of one week by giving in writing by the 20% Taluka
pratinidhis. Article
9.3 : Vidhan
Sabha will elect Raj pramukh by secret ballot by all taluka pratinidhis. Article
9.4 : Taluka
pratinidhi will be entitled to give the votes in any election equivalent
to the population which he represents divided by 10000. (fractions to be
ignored) Article
9.5 : No
person shall be elected as Raj pramukh unless he gets 80% of the totally
casted votes. Article
9.6 : Raj
pramukh will hold the office during the pleasure of the vidhan shabha and
he will leave the post forthwith on passing of call back resolution
against him. Article
9.7 : Call
back resolution against Raj pramukh can be passed by simple majority in
vidhan sabha at any moment. Article
9.8 : No
person shall be eligible to be elected as Raj pramukh unless (i) He/she is
citizen of India and born in India (ii) He/she has completed 25 years of
age. (iii) He/she is free from any addiction such as Smoking, Gutkha, Pan,
Tobacco, Wine, Gambling or any such bad habit. (iv)He/she declares the
property of his own and of his family members to the public and there is
no opposition about the unlawful manner of acquiring the property. (v)
He/she is not convicted of any offence. (vi)He/she bears undisputable
moral character. (vii) He/she is graduate of any university. (viii) He/she
has well studied atleast 10 books written by Mahatma Gandhi including
Autobiography of Mahatma Gandhi, Satyagrah in South Africa, Hind Swaraj
etc. (ix) He/she has studied constitution of India. Article
9.9 : Vidhan
sabha will act as a executive and implementing body of the state. Article
9.10 : Vidhan
sabha may appoint unanimously various samitis for the purpose of various
functions and subjects related with the Village List, District list and
State List wherever applicable. 20% members of such samitis will be women.
Article
9.11 : Any
samiti constituted by Vidhan sabha for any subject related to women
directly or indirectly shall have atleast 60% women members. Article
9.12 : 20%
members of the Vidhan sabha shall be women. STATE JUDICIARY : Article
9.13 : There
shall be Rajya Nyay Parishad in every state. Article
9.14 : Number
of members of Rajya Nyay Parishad will be equivalent to population of the
state divided by 10 lakhs. (fraction to be ignored) Article
9.15 : Members
of Rajya Nyay Parishad will be selected and elected as per the following
procedure : (a) Entire state will be divided into various constituencies for this
purpose equivalent to the number of members with more or less equal
population. (b) Every Gram Nyay Punch Pramukh will have voting rights equivalent to
population which he represents divided by 1000. Each vote will be in a
special yellow ballot paper. (c) Every Taluka Nyay Punch Pramukh will have voting rights
equivalent to population which he represents divided by 5000. Each vote
will be in a special blue ballot paper. (d) Every Gram Nyay Punch Pramukh will suggest and write down one name in
one ballot paper which he considers best person as the member of Rajya
Nyay Parishad. He can write same name in all the ballot papers he is
entitled to cast. or different different names in each ballot paper in his
possession. (e) Every Taluka Nyay Punch Pramukh will suggest and write down one name
in one ballot paper which he considers best person as the member of Rajya
Nyay Parishad. He can write same name in all the ballot papers he is
entitled to cast. or different different names in each ballot paper in his
possession. (f) Person getting the highest votes in this system will be
requested to accept the membership of Rajya Nyay Parishad. If he agrees
and if he fulfills the qualifications required for Jilla Nyay Punch
Pramukh, his name will be informed to all the voters i.e. All Gram Nyay
Punch Pramukhs and all Taluka Nyay Punch Pramukhs to invite objections if
any. If there is no any serious objection, he becomes member of Rajya Nyay
Parishad. (g) If he does not agree, next person getting the second highest votes
will be requested to accept the membership of the Rajya Nyay Parishad and
procedure will be repeated. Article
9.16 No
person shall be eligible to be selected or elected as the member of Rajya
Nyay Parishad unless he has qualifications prescribed for Raj Pramukh. Article
9.17 Members
of Rajya Nyay Parishad will select one person as the chairman of the Rajya
Nyay Parishad as per the above method by suggesting only one vote for each
member. Article
9.18 Chairman
of Rajya Nyay Parishad will hold the office for three years unless call
back resolution has been passed by the members of the Rajya Nyay Parishad
with 80% votes of the totally casted votes. Article
9.19 Rajya
Nyay Parishad may appoint unanimously different samitis for the purpose of
various functions and subjects related with justice. Decision of such
samitis will be considered as the decision of Rajya Nyay Parishad. Article
9.20 : Rajya
Nyay Parishad will have powers and jurisdiction to decide the cases of
disputes and offences and appeals between the individuals, between
individual and state or Government authority, between districts, between
talukas, between villages or any Government authority and punish the
culprits as per their discretion. Article
