CHAPTER 10 : COMPOSITION OF UNION ADMINISTRATION |

Article
10.1 : There
shall be Lok sabha in Bharat composed of 250 eligible elected Jilla
pratinidhis in the Districts. They will be called members of lok sabha. Article
10.2
: Every
Jilla pratinidhi will be entitled to have voting right equivalent to the
population which he represents divided by 100000. (fractions to be
ignored). Article
10.3 : Any
jilla pratinidhi may assign his voting rights to any other jilla
pratinidhi in his state. Article
10.4 : No
any jilla pratinidhi will become the member of lok sabha unless he has 40
voting rights. Article
10.5 : Lok
sabha will meet every two months. But Lok Sabha can be convened at any
time with the notice of one week by giving in writing by the 20% members
of Lok Sabha. Article
10.6 : Lok
Sabha will elect President of India by secret ballot by all members of Lok
Sabha. Article
10.7 : No
person shall be eligible to be elected as president of India unless (i)
He/she is citizen of India and born in India (ii) He/she has completed 30
years of age. (iii) He/she is free from any addiction such as Smoking,
Gutkha, Pan, Tobacco, Wine, Gambling or any such bad habit. (iv) He/she
declares the property of his own and of his family members to the public
and there is no opposition about the unlawful manner of acquiring the
property. (v) He/she is not convicted of any offence. (vi) He/she bears
undisputable moral character. (vii) He/she is graduate of any university.
(viii) He/she has well studied atleast 10 books written by Mahatma Gandhi
including Autobiography of Mahatma Gandhi, Satyagrah in South Africa, Hind
Swaraj etc. (ix) He/she has studied constitution of India. Article
10.8 : Lok
sabha will act as a executive and implementing body of the union. Article
10.9 : President
may appoint various ministers from the members of The Lok Sabha for the
purpose of various functions and subjects related with the Union List and
State List wherever applicable. Each minister will appoint samiti of 5 to
7 members from the members of Lok Sabha. 20% members of such samitis will
be women. Article
10.10 : Any
samiti constituted by Lok sabha for any subject related to women directly
or indirectly shall have atleast 50% women members. Article
10.11 : 20%
members of the Lok sabha shall be women. Article
10.12 : President
of India will hold the office during the pleasure of the lok sabha but
maximum upto 3 years. And he will leave the post forthwith on passing of
call back resolution against him by lok sabha. Article
10.13 : Call
back resolution against president of India can be passed by simple
majority in Lok Sabha at any moment. UNION JUDICIARY: Article
10.14 : There
shall be Rashtriya Nyay Sabha which shall be apex body for judiciary.
Article
10.15 : Rashitrya
Nyay Sabha will be composed of 100 members. Article
10.16 : Members
of Rashtriya Nyay Sabha will be selected and elected as per the following
procedure : (a) Entire country will be divided into 100 constituency for this purpose
only with more or less equal population. (b) Every Taluka Nyay Punch Pramukh will have voting rights equivalent to
population which he represents divided by 25000. Each vote will be in a
special red ballot paper. (c) Every Jilla Nyay Punch Pramukh will have voting rights
equivalent to population which he represents divided by 100000. Each vote
will be in a special green ballot paper. (d) Every Taluka Nyay Punch Pramukh will suggest and write down one name
in one ballot paper which he considers best person as the member of
Rashtriya Nyay Sabha. He can write same name in all the ballot papers he
is entitled to cast. or different different names in each ballot paper in
his possession. (e) Every Jilla Nyay Punch Pramukh will suggest and write down one name
in one ballot paper which he considers best person as the member of
Rashtriya Nyay Sabha. He can write same name in all the ballot papers he
is entitled to cast. or different different names in each ballot paper in
his possession. (f) Person getting the highest votes in this system will be
requested to accept the membership of Rashtriya Nyay Sabha. If he agrees
and if he fulfills the qualifications required for Chairman of Rajya Nyay
Parishad, his name will be informed to all the voters i.e. All Taluka Nyay
Punch Pramukhs and all Jilla Nyay Punch Pramukhs to invite objections if
any. If there is no any serious objection, he becomes member of Rashtriya
Nyay Sabha. (g) If he does not agree, next person getting the second highest votes
will be requested to accept the membership of the Rashtriya Nyay Sabha and
procedure will be repeated. Article
10.17 : No
person shall be eligible to be selected or elected as the member of
Rashtriya Nyay Sabha unless he has qualifications prescribed for Raj
Pramukh of the State. Article
10.18 : Members
of Rashtriya Nyay Sabha will select one person as the chairman of the
Rashtriya Nyay Sabha as per the above method by suggesting only one vote
for each member. Article
10.19 : Chairman
of Rashtriya nyay sabha will hold the office for three years unless call
back resolution has been passed by the Rashtriya Nyay Sabha with 80% votes
of the totally casted votes. Article
10.20 : Rashtirya
Nyay Sabha may appoint unanimously different samitis for the purpose of
various functions and subjects related with justice. Decision of such
samitis will be considered as the decision of rashtriya nyay sabha. Article
10.21 : Rashtriya
Nyay Sabha will have powers to decide the cases of disputes and offences
and appeals between the individuals, between individual and state, between
States, Districts or any Government authority and punish the culprits as
per their discretion. Article
10.22 : Rashtriya
Nyay Sabha has the responsibility
to see that administration of union is conducted as per the provisions of
the constitution. Any person, can complain to the Rashtriya nyay sabha if
birth rights are violated or compulsory commands are violated or
Restrictions on Government are not complied with and any provision of
constitution is violated. Rashtriya Nyay Sabha will give the judgement at
their discretion. COMPTROLLER
AND AUDITOR – GENERAL : Article
10.23 : There
shall be Comptroller and Auditor General of India who shall be appointed
by the President as per the advice of Rashtriya Nyay Sabha from the
members of Rashtriya Nyay Sabha. Article
10.24 : Comptroller
and Auditor General will ensure that expenditure in all Government offices
are duly audited by private Chartered Accountants and not by Government
officers. Article
10.25 : Comptroller
and Auditor General will ensure that auditing of the Government
expenditure is assigned to different different reputable and experienced
charted accountant firms at most competitive and reasonable rates. Article
10.26 : Comptroller
and Auditor General will ensure that all audit reports of Government
offices and departments of the Union, States and Districts are duly
brought to the notice of the concerned public by way of availability of
audit reports to interested people, publishing the public interest
articles in the concerned news papers (not as advertisements) and such
other ways and means deemed fit to the comptroller and auditor general. Article
10.27 : Comptroller
and Auditor General will bring to the notice of Rashtriya Nyay Sabha or
Rajya Nyay Parishad whichever is applicable about serious defects, misuse
of funds, unauthorized expenditure, fraud, misappropriation of Government
fund etc with request to take action against misusers of government fund. Article
10.28 : Any
Chartered Accountant involved in auditing of Government expenditure is
found guilty of any incorrect statement, false statement, any undue favor
or concealing any fault or fraud or wrong expense by any Government
authority may be punished for imprisonment up to by 10 years. ELECTIONS : Article
10.29 : Supritendence,
direction and control of the preparation of the electoral roll for all
elections of Lok Sabha, Vidhan Sabhas, Rashtriya Nyay Sabha, Rajya Nyay
Parishads and districts shall be vested in a Election Commission. Article
10.30 : President
will appoint one or more election commissioners from the members of the
Rashtriya Nyay Sabha and will assign the responsibility of election to
them either jointly or severally. |
